Terms & Conditions
These Terms and Conditions govern your use of LetDirect. Please read them carefully before creating an account or publishing a listing.
Last updated: 2 October 2026
1. General
These Terms and Conditions ("Terms") govern your access to and use of letdirect.co.za and any related services provided by Letdirect (Pty) Ltd (registration number 2026/672103/07) ("Company", "we", "us", or "our"). By creating an account, publishing a listing, or otherwise using the services, you agree to be bound by these Terms.
These Terms form the entire agreement between you and the Company regarding your use of the services, except where additional terms expressly apply to a specific feature or offering.
Nothing in these Terms limits any rights you may have under mandatory applicable law.
2. Services
The services include access to property listings submitted directly by landlords and private sellers, saved-search alerts, notifications, and paid features such as listing publication, made available through letdirect.co.za.
We may update, improve, suspend, or discontinue all or part of the services from time to time, including where required for technical, legal, operational, or commercial reasons.
3. LetDirect's Role
LetDirect is an advertising platform that connects landlords and private sellers directly with tenants and buyers. We are not an estate agent, attorney, or financial adviser, and we are not a party to any lease, sale, or other agreement between users.
We moderate listings before they are published, but we do not verify every detail of a listing or the identity of every user. You deal and negotiate directly with the other party, and you are responsible for your own decisions. Always view a property and confirm who you are dealing with before signing an agreement or paying any deposit or other money.
4. Eligibility and User Obligations
By using the services, you represent and warrant that you are at least 18 years old, or the age of legal majority in your jurisdiction, and that the information you provide during registration is accurate and complete.
You agree not to:
- Share your personal account with others.
- Violate applicable laws or these Terms.
- Upload unlawful, offensive, fraudulent, or misleading content.
- Infringe any third-party intellectual property or other rights.
- Collect data about other users without a lawful basis or consent.
- Use bots, scrapers, crawlers, or other automated means without our prior written permission.
- Disrupt, overload, test, or interfere with the platform or its infrastructure.
All property listings and other content you submit must also comply with our Advertising Standards, available here.
You remain responsible for all fees, charges, and properly issued invoices already accrued at the time your account is suspended or terminated.
If you breach these Terms, we may remove content, suspend access, or terminate your account in accordance with Section 11 (Misuse and Enforcement).
Accounts that are not used for 12 months, and sign-ups whose email address is not confirmed within 30 days, are deleted as described in our Privacy Policy. We email you before deleting an unused account, and signing in keeps it.
5. Advertising Standards
Property listings and any other advertising content you submit to LetDirect must meet the following standards:
- Honesty and accuracy: listings must accurately describe the property, including size, condition, price, availability, and location. Nothing may mislead, exaggerate, or omit material facts likely to affect a tenant's decision.
- Respect and non-discrimination: content must not be offensive or discriminatory, and must comply with South African law, including the Rental Housing Act 50 of 1999 and the Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000.
- No unlawful content: listings must not promote or facilitate illegal activity, fraud, or unsafe practices.
- Fair comparisons: any comparison with other properties, landlords, or platforms must be factual, substantiated, and not disparaging.
- Privacy: content must not include images, names, or other personal details of identifiable individuals without their consent, other than the property itself.
- Pricing clarity: advertised rental prices must reflect the full amount payable, with any additional compulsory costs (such as deposit, levies, or utilities) clearly stated.
We may remove, edit, or refuse to publish any listing or content that does not meet these standards, in accordance with Section 11 (Misuse and Enforcement).
6. Fees and Payments
LetDirect does not operate a subscription model. All fees are once-off:
- Landlords and private sellers pay a once-off fee to publish a listing for a fixed period, as shown at checkout. Listings do not renew automatically; you may publish again for a further period by paying the applicable fee.
Browsing listings and contacting a landlord or seller (by phone, WhatsApp, or the on-site message form) are free for every visitor and require no payment.
Current prices are displayed on our Pricing page and confirmed again at checkout before payment. We may change prices at any time for future purchases; a price change does not affect fees you have already paid.
You authorise us to process payment via the payment method(s) we make available at checkout (currently SnapScan and EFT). Unless required by applicable law, fees already paid are non-refundable once the corresponding service (listing publication) has been provided.
7. Right of Withdrawal
If you are a consumer, you may have a statutory right to cancel certain transactions concluded electronically, including under the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").
Where you ask us to begin providing a service immediately, for example by publishing a listing as soon as your payment is confirmed, you acknowledge that once we have begun or completed that service at your request, your right to cancel that specific transaction may no longer apply, to the extent permitted by law.
Nothing in these Terms is intended to exclude or limit any right you have under the Consumer Protection Act 68 of 2008, or any other applicable law that cannot lawfully be excluded.
8. Content and Intellectual Property
If you upload, submit, or otherwise make content available through the services, you confirm that you own that content or have the necessary rights to use it and to grant the licence described in this Section.
You grant the Company a non-exclusive, worldwide, royalty-free licence for the duration of the applicable rights to host, reproduce, adapt, display, communicate, and distribute such content only to the extent reasonably necessary to operate, maintain, improve, promote, and provide the services.
We may remove or restrict access to any content that we reasonably believe is unlawful, misleading, infringing, or otherwise in breach of these Terms or applicable law.
Landlords and sellers are solely responsible for the content of their listings, including descriptions, prices, and photos. You indemnify the Company against any claim, loss, or cost arising from content you submit, including claims that it infringes someone else's copyright or other rights, or that it is false or misleading.
Except for the limited rights expressly granted to you under these Terms, all rights, title, and interest in and to the services, including our software, branding, and platform content, remain with the Company or its licensors.
LetDirect™ is a trade mark used by the Company, and an application to register it is pending in South Africa. You may not use the LetDirect name or logo, or anything confusingly similar, without our prior written permission.
If you have any questions regarding the content on our website, contact support@letdirect.co.za.
9. Privacy
We collect and use your personal information to provide the services, in line with the Protection of Personal Information Act 4 of 2013 ("POPIA"). Our Privacy Policy explains what we collect, why, who we share it with, and your rights.
10. Availability, Disclaimers, and Limitation of Liability
We aim to keep the services available and current, but we do not guarantee uninterrupted access, error-free operation, or that listings, alerts, or other content will always be complete, accurate, current, or available.
To the extent permitted by applicable law, the services are provided "as is" and "as available" without warranties of any kind, whether express or implied.
We are not responsible for user-generated content or for third-party content, websites, listings, or services that may be referenced, linked, cached, indexed, or displayed through the platform.
To the fullest extent permitted by applicable law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or opportunity arising out of or in connection with the services or these Terms.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.
11. Misuse and Enforcement
We may investigate suspected misuse of the services and may remove content, restrict functionality, suspend accounts, terminate access, or take other reasonable action where we believe a user has breached these Terms, violated applicable law, or misused the platform.
Where appropriate and legally permitted, we may also report unlawful conduct to relevant authorities or pursue available legal remedies.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa, excluding its conflict-of-laws rules.
If you are a consumer resident outside South Africa, this choice of law does not deprive you of any mandatory protections granted to you by the laws of the country in which you habitually reside.
Any dispute arising out of or in connection with these Terms shall be submitted to the competent courts of South Africa, unless applicable mandatory law gives you the right to bring proceedings in another court or requires a different forum.
13. Governing Language
These Terms have been originally drafted in the English language. Any translation is provided for convenience only and may be produced using translation services.
To the fullest extent permitted by applicable law, if any inconsistency, ambiguity, omission, error, or dispute arises from or in connection with a translated version, the English version shall prevail and shall be used by both you and the Company as the authoritative text for interpreting and construing these Terms in good faith.
